NFP SOFTBALL
PARTICIPANT & FAMILY AGREEMENT, WAIVER OF LIABILITY, AND RELEASE
Effective for all participants, parents, guardians, coaches, volunteers, sponsors, and administrative staff of FO32, LLC d/b/a NFP Softball ("NFP"), a professional travel fastpitch softball organization based in the State of Georgia.
1. ASSUMPTION OF RISK
I understand and acknowledge that participation in fastpitch softball and related activities — including but not limited to practices, games, tournaments, travel, training sessions, tryouts, and team events — involves inherent risks of physical injury, illness, or death. These risks include, but are not limited to: being struck by a ball or bat, collisions with other players or objects, falls, overexertion, equipment failure, adverse weather conditions, and travel-related incidents. I voluntarily assume all such risks on behalf of myself and/or my minor child(ren).
2. RELEASE & WAIVER OF LIABILITY
In consideration of being permitted to participate in NFP activities, I, on behalf of myself, my minor child(ren), heirs, executors, administrators, and assigns, hereby release, waive, discharge, and covenant not to sue FO32, LLC d/b/a NFP Softball, its owners, directors, coaches, staff, volunteers, sponsors, and affiliated organizations (collectively "Released Parties") from any and all liability, claims, demands, actions, or causes of action arising out of or related to any loss, damage, or injury — including death — that may be sustained by me or my minor child(ren) while participating in any NFP activity, whether caused by the negligence of the Released Parties or otherwise.
3. INDEMNIFICATION
I agree to indemnify and hold harmless the Released Parties from any and all loss, liability, damage, cost, or expense (including reasonable attorney's fees) incurred by the Released Parties as a result of any claim made by or on behalf of myself or my minor child(ren) arising from participation in NFP activities.
4. MEDICAL AUTHORIZATION & EMERGENCY TREATMENT CONSENT
I authorize NFP staff to consent to any necessary emergency medical treatment for my minor child(ren) when I cannot be reached immediately. I understand that NFP Softball is not responsible for any medical expenses incurred. I confirm that I carry appropriate health insurance and authorize NFP to take all steps it deems reasonably necessary to protect the health and safety of my child(ren) during NFP activities. I agree to maintain current emergency contact information on file with NFP at all times.
5. MEDIA RELEASE & INTELLECTUAL PROPERTY
I grant FO32, LLC d/b/a NFP Softball the perpetual, royalty-free right to photograph, film, record, and use the name, image, likeness, and voice of myself and/or my minor child(ren) in any media — including social media, websites, promotional materials, and broadcasts — for organizational, promotional, and commercial purposes. I waive any right to compensation or approval of such use.
6. BACKGROUND CHECK CONSENT & ACKNOWLEDGMENT
Parents and guardians acknowledge that all coaches, volunteers, and administrative staff of NFP Softball are required to undergo a criminal background check as a condition of working with minor athletes. Coaches, volunteers, and administrative staff, by signing this agreement, additionally consent to that background check being conducted by a third-party provider selected by NFP. Results are kept confidential and used solely to protect the safety of our athletes.
7. CODE OF CONDUCT
All participants, parents, guardians, coaches, and volunteers agree to conduct themselves in a respectful, sportsmanlike manner at all times. NFP Softball operates a zero-tolerance policy for bullying, harassment, abuse, discrimination, and unsportsmanlike conduct directed at athletes, coaches, officials, or opposing teams. NFP reserves the right to dismiss any member of the organization — player, parent, coach, or volunteer — whose conduct is deemed harmful to athletes, the team, or the organization's reputation. No refunds will be issued following dismissal for conduct violations.
8. FINANCIAL OBLIGATIONS & REFUND POLICY
Tournament fees, training fees, and other organizational fees are due as communicated by NFP leadership. Fees are generally non-refundable once committed, except in cases of season cancellation by NFP. Families are responsible for their share of tournament entry fees, travel costs, and uniform costs as outlined at time of registration. Failure to meet financial obligations may result in suspension from participation.
9. TRAVEL CONSENT
I authorize my minor child(ren) to travel with NFP coaches, staff, and/or other team families to tournaments and events. I understand that NFP Softball takes reasonable precautions for player safety during travel but cannot be held liable for incidents occurring during travel to or from events. I agree to provide current insurance and emergency contact information prior to any travel event.
10. SOCIAL MEDIA POLICY
All members agree not to post content that disparages NFP Softball, its coaches, staff, athletes, or affiliated organizations on any public platform. Parents and guardians are responsible for their minor child(ren)'s social media conduct as it relates to the organization. Violations may result in suspension or dismissal from the program.
11. PRIVACY & DATA
NFP Softball collects and stores personal information — including name, contact information, date of birth, and medical information — solely for organizational purposes. This information will not be sold or shared with third parties except as required by law or necessary for the operation of NFP activities (e.g., tournament registration systems).
12. GOVERNING LAW & SEVERABILITY
This agreement shall be governed by the laws of the State of Georgia. If any provision of this agreement is found to be unenforceable, the remaining provisions shall continue in full force and effect. This agreement constitutes the entire understanding between the parties with respect to its subject matter.
13. ACKNOWLEDGMENT
I acknowledge that I have read this entire agreement, that I understand its terms, that I have had the opportunity to seek legal counsel if desired, and that I am signing it voluntarily. I understand that this is a legally binding agreement between myself and FO32, LLC d/b/a NFP Softball, and that by submitting this registration I am waiving significant legal rights.
